Terms of Service

Welcome to DigitalPilot. These Terms of Service ("Terms") govern your access to and use of DigitalPilot's websites, applications, and related services (the "Service"). The Service includes website visitor intelligence, contact search, email reveal, email verification, and integrations you connect through an API connection or an OAuth connection. Please read these Terms carefully before using the Service.

Accepting Terms

By accessing the DigitalPilot site, registering an account, connecting an integration, or using the Service, you agree to these Terms. If you use the Service for an organization, you confirm that you have authority to bind that organization.

Changes to Terms

DigitalPilot may modify these Terms at any time. Changes are effective when we post the revised Terms. Your use of the Service after that date means you accept the updated Terms. The date at the top of this page is the date of the current Terms.

The Service

DigitalPilot provides software that identifies the company associated with a visit to a website where our tracking tag is installed, using the visitor's IP address, and shows that company information in your workspace.

The Service also lets you search for people who work at a company, reveal a work email address, and verify an email address. Through an API connection or an OAuth connection, you can save a person you choose into a system you connect. We may modify or discontinue any part of the Service with notice. DigitalPilot is not liable to you or any third party for that modification or discontinuance.

Contact search, email reveal, and email verification

Contact search, email reveal, and email verification return personal data about named people. That data is supplied by third-party partners. It is separate from IP-based company identification, and it is not collected from the person's visit to your website.

When you search a company domain, we ask our contact-data partner for people at that domain. Results can include a person's name, job title, seniority, department, phone number, LinkedIn profile, and the partner's verification status, when the partner has those fields. The email address stays hidden until you reveal it. Verification checks the address format, common typos, disposable domains, and the mail server, and then checks the mailbox.

If you save a person through an API connection or an OAuth connection, we send that person's name, work email, job title, phone number, and LinkedIn profile to the connected system and link the person to the company. If you store a verification result, we write whether the email is valid on the person field you selected. You choose when to search, reveal, verify, and save.

You may use contact data only for your own legitimate business purposes, inside DigitalPilot and in systems you connect through an API connection or an OAuth connection. You will not resell it, sublicense it, or use it to build a database or product for others. You are responsible for having a lawful basis for each search, reveal, verification, and message you send, and for complying with the privacy and electronic-marketing laws that apply to you. People you save in a connected system remain in that system under its terms, including after you disconnect DigitalPilot.

Data Practices

Website visitor identification uses an IP address and related network data to determine the company visiting a site. That feature identifies the company. It does not, by itself, name the individual visitor. If you turn on lead capture, we also store the email address and form details a visitor submits on your site.

Contact search, email reveal, and email verification access, receive, and store personal data about named people, including work email addresses, phone numbers, and LinkedIn profiles. We process that data to provide the feature you requested. We do not sell personal information.

Cancellation & Termination

DigitalPilot reserves the right to suspend or terminate your access to the Service with notice if there is evidence of a violation of these Terms or of illegal or fraudulent activity.

Intellectual Property

All content and materials on the DigitalPilot site and tools, including brands, logos, data, images, and software, are the exclusive property of DigitalPilot and its licensors and are protected by copyright and trademark laws. Contact data returned by our partners is licensed for use inside the Service. You do not receive a right to republish or resell it.

Disclaimer of Warranties

DigitalPilot offers the Service on an "as-is" basis without warranties of any kind, express or implied. We disclaim warranties of accuracy, reliability, title, merchantability, non-infringement, and fitness for a particular purpose. Company identification, contact data, and email verification results come from third parties and network data. They can be incomplete or out of date. You are responsible for how you use them.

Limitation of Liability

In no circumstance shall DigitalPilot be liable for any indirect, punitive, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the fees you actually paid to DigitalPilot for the Service during the twelve months before the claim.

Indemnification

You will defend and indemnify DigitalPilot from damages and costs arising from a third-party claim based on your use or misuse of the Service, your search, reveal, verification, storage, or use of contact data, your communications with people identified through the Service, your violation of these Terms, or your breach of applicable law.

Governing Law

These Terms are governed by the laws of Canada. You agree to the exclusive jurisdiction of the courts of Canada for disputes arising under these Terms.
